2.1. Soltec collects different information from Users, which is not always provided directly by the User who accesses, registers or interacts on the Website and which differs according to the form used (the “Personal Data”):

(i) “Work with us” form (link): With this form, Soltec collects the name and surname, telephone, e-mail, country, profession, level of experience, languages, cover letter and CV of each User who wants to join the Soltec team or any company of the group.

(ii) Get more information” Form (link): with this form, Soltec collects the name, last name, e-mail, mobile phone, company and country of each User who wishes to obtain more information about “Solteach Profesional”, “Solteach Projects” or both.

2.2. Also, Soltec can register the visits of the Users on the Website, the use that Users make of the Website and its links or when the User clicks on a content, interacts, or in any other way makes use of the Website.

3. Use of Personal Data and Legal Basis for Processing

Soltec, in order to enforce this privacy policy, has adopted the technical and organizational security measures that are necessary to avoid the alteration, loss, misuse, treatment and unauthorized access or theft of data of Users. Among them, Soltec has implemented an Information Security Management System that effectively complies with international standards.

3.1. Soltec uses the Personal Data of the Users provided or collected in accordance with this Privacy Policy to provide, personalize, develop and, in short, improve the provision of the services offered on the Website.

3.2. The precise way in which Soltec uses the Personal Data of the Users will depend, ultimately, on the use of the Website made by each User.

3.3. Soltec will use the Personal Data for the provision of services through the Website and, in particular, for the following purposes:

3.3.1 Personnel recruitment. Based on the consent of the Users by ticking the corresponding box, as well as, once the recruitment process is advanced, the execution of the pre-contractual relations between Soltec and the job applicant, Soltec may process the Personal Data within the framework of a Soltec recruitment process, with the aim of analyzing the competencies and aptitudes of the candidate, generating a profile of the same, and evaluating the candidacy of the applicants for the jobs that may be available to Soltec at the time of presenting the application or while said data are retained by the referred entity for the same purposes.

The processing of your data for these purposes also includes the processing of data concerning health, such as your degree of disability, to the extent that this is strictly necessary for the recruitment process. For this purpose, the User explicitly consents to the processing of his or her Personal Data, understanding that it is necessary for the management of his or her request and that, if this is not done, we will not be able to include him or her in the Soltec recruitment processes.

If the User accepts this, Soltec may also evaluate the application for work positions in other companies of the group.

3.3.2 “Get More Information” form. Based on the consent of Users by checking the corresponding box, and the legitimate interest of Soltec in attending to their request, Soltec may process the User’s Personal Data in order to attend to their queries and send them the information they request regarding the Solteach Pro program.

3.3.3. Other. Based on the legitimate interest of Soltec, the Personal Data of the Users may also be used for the purpose of researching and analyzing the use of the Website, to improve the services provided to the Users and to offer them greater security in relation to their Personal Data and the use of the Website. To this end, Soltec itself as well as through third parties when necessary, will conduct research, studies, statistics, surveys, usage metrics, policy improvement, study of market trends, use of data for fraud prevention, etc. As far as possible, the information used for this purpose will be aggregated at a statistical level, without identification of the User.

3.4. The Personal Data provided will not be shared or used for purposes other than those set out in this Privacy Policy.

4. Who accesses the users’ data? Who are the recipients?

4.1. Users’ personal information will only be accessible in accordance with this Privacy Policy.

4.2. Workplaces. The Personal Data collected for personnel recruitment purposes may be transmitted to the different work centers that manage and have recruitment processes appropriate to their profile.

4.3. Group companies. If requested by the User, Soltec may also transfer the Personal Data of the Users who have sent their CV for the purpose of personnel recruitment to the companies of its business group, with the aim of evaluating the User’s candidacy for different job positions in the different companies of the group. Likewise, if the request for information or contact is related to one of the companies of the group, Soltec may also transmit the request in order to provide the requested information.

4.4. Service providers. Soltec may use other companies to provide certain services under Soltec’s guidelines. For the provision of such services (e.g. consulting, auditing, IT-maintenance, hosting server or web platform or social networks such as Facebook, Linkedin, YouTube or Twitter), those third parties may need certain information and data from Users. Soltec guarantees that, in such cases, the said third parties will have limited access to the information on the Users to the extent necessary to carry out the tasks entrusted to them, will sign a contract with Soltec for the processing of the information and will be obliged not to disclose the information or use it for purposes other than the provision of the corresponding service.

4.5. Disclosures required by law. Soltec may communicate Personal Data and information provided by Users when required by law, in a judicial proceeding, to investigate a suspicious activity, or to otherwise protect its own rights and those of the Users. In such cases, Soltec undertakes to notify the Users that their data has been legally requested, insofar as this is possible and in cases where such communication is not incompatible with the purpose for which the data were initially disclosed.

5. Retention of Personal Data

5.1. Soltec retains most of the Personal Data as long as it is necessary to fulfil the purposes indicated above. Once the purposes have been fulfilled, Soltec will keep the Personal Data, blocked, to the extent that responsibilities may arise for Soltec or in any other way that is legally required. As far as possible, the information will be deidentified once the User has closed his or her account. In particular:

(i) Personnel recruitment: during the recruitment process and, once it has been completed, for a period of one year from the date on which the application is received or from your last show of interest in a Soltec application or from your last communication. Once the above period has expired, your data will be cancelled.

(ii) Solteach Pro information request: to the extent necessary to provide Users with the requested information and answer the query.

6. Where is the Personal Data stored?

6.1. Soltec collects, stores and processes the Personal Data of Users on different servers within the European Economic Area, and also carries out international transfers of the Personal Data to countries that may not guarantee the same level of protection in terms of data protection.

6.2. In such cases, Soltec shall only carry out such international transfers of data to third countries for which the Commission has issued a decision on adequacy or, failing that, adequate safeguards have been provided through the signature of standard clauses or an intra-group contract. Users may request a copy of these guarantees at the address indicated in this Privacy Policy. Specifically, Soltec will transfer data outside the European Economic Area to the following countries:

(i) Declared as adequate by the European Commission: Argentina and the United States.

(ii) Not declared as adequate by the European Commission: Australia, Peru, Brazil, Chile, Colombia, India and Mexico.

7. Representation and guarantees

If Personal Data of third parties is provided, the User is responsible for having informed and obtained the consent of these third parties to be provided for the purposes indicated in the corresponding sections of this Privacy and Cookies Policy.

7.2. Any loss or damage caused to the Website or to the person responsible for the Website or any third party through the communication of erroneous, inaccurate or incomplete information in the registration forms will be the sole responsibility of the User.

9. Exercise of Users’ Rights

10. Minors

10.1. In general, and to the best of Soltec’s knowledge, Soltec will not process Personal Data of children under 14 years of age.

10.2. If during any of its control actions of the Soltec Website discovers the involuntary collection of Personal Data from minors under 14 years of age, it will adopt the necessary measures that, as a service provider and as the person responsible for the processing, it has the obligation to undertake in order to delete such Personal Data as soon as possible.
